Agreement to Terms

Welcome to Omni Aura LLC ("Omni Aura", "we", "us", or "our"). These Terms of Service ("Terms") govern your access to and use of our website, applications, and other products and services (collectively, the "Services").

We reserve the right to refuse service, terminate accounts, or remove or edit content in our sole discretion.

User Content

Our Services may allow you to submit, post, or display content, including but not limited to text, graphics, photos, videos, and links ("User Content"). You retain all ownership rights in and are solely responsible for your User Content. You grant us a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use, reproduce, modify, adapt, publish, translate, distribute, and display your User Content in connection with operating and providing the Services.

Please be mindful that your content may include sensitive personal information. You are solely responsible for the content you share. We do not claim ownership of your content but require the license described above to operate and improve the Services.

You represent and warrant that you own all rights in and to your User Content or that you have all necessary rights and permissions to grant us the license above.

Prohibited Conduct

You are responsible for all activity and content (including User Content) associated with your use of the Services.

You agree not to engage in any of the following prohibited activities:

• Attempting to reverse engineer, misuse, or exploit the AI models or APIs underlying the Services.
• Using any automated systems, including but not limited to "bots", "scrapers," or "offline readers" to access, interact with, or collect data from the Services.

Intellectual Property Rights

The Services and their entire contents, features, and functionality, including but not limited to information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof, are owned by Omni Aura, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

User-generated content remains your property, but the underlying software and AI models are owned by Omni Aura and its licensors.

User Data and Privacy

Your use of the Services is also governed by our Privacy Policy, which explains how we collect, use, and protect your information. By using the Services, you consent to the collection and use of your information as described in our Privacy Policy.

Third-Party Services

The Services may integrate with third-party AI providers (including OpenAI and Google AI) and other service providers whose terms and privacy policies apply to their processing of your data. We are not responsible for the practices of these third-party providers, though we require them to comply with confidentiality agreements and applicable data protection laws.

Termination

We may terminate your access to all or any part of the Services at any time, with or without cause, with or without notice, effective immediately. We will attempt to notify you when possible and provide a brief explanation when appropriate.

Upon termination, your access to the Services will end immediately. We may delete or retain your data as described in our Privacy Policy.

Disclaimer of Warranties

The Services and all information, content, materials, products, and other services included on or otherwise made available to you through the Services are provided by Omni Aura on an "as is" and "as available" basis.

The AI-generated content provided by the Services is for informational purposes only and may be inaccurate or incomplete. It is not a substitute for professional advice, including medical, legal, financial, or therapeutic advice.

Omni Aura makes no representations or warranties of any kind, express or implied, as to the operation of the Services or the information, content, materials, products, or other services included on or otherwise made available to you through the Services. You expressly agree that your use of the Services is at your sole risk.

Limitation of Liability

To the fullest extent permitted by law, Omni Aura, its officers, directors, employees, agents, licensors, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses.

We exclude liability for damages arising from data loss, unauthorized access, or security breaches, particularly given the current limitations in our encryption and security features.

Indemnification

You agree to indemnify and hold harmless Omni Aura and its affiliates, officers, directors, employees, agents, licensors, and suppliers from any claims, damages, liabilities, and expenses (including reasonable attorney's fees) arising from your use of the Services, your violation of these Terms, or your violation of any rights of another party.

Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Alabama, without regard to its conflict of law principles.

Any disputes arising under these Terms shall be resolved through binding arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules. The arbitration shall take place in Alabama, and judgment on the arbitral award may be entered in any court having jurisdiction thereof.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.
